1. General Information

These terms govern the use of brandnewclothes.shop and any purchases made through it. By using this website or placing an order, you agree to these terms.

2. Products

All products are described as accurately as possible. Due to the nature of upcycled and handmade items, slight variations in colour, texture and finish are normal and part of each piece’s unique character.

Images are representative. For upcycled and one-of-a-kind items, the actual product may differ slightly from the photograph.

Prices are displayed in euros (EUR) and include VAT where applicable. We reserve the right to change prices at any time, but changes will not affect orders already placed.

3. Orders and Payment

By placing an order, you are making an offer to purchase. We will confirm acceptance by sending an order confirmation email.

We accept payment via credit/debit card (processed by Stripe) and PayPal. Payment is taken at the time of purchase.

We reserve the right to refuse or cancel any order for reasons including stock availability, pricing errors, or suspected fraud.

4. Shipping

Orders are processed within 1-3 business days. Delivery times depend on your location:

  • Spain: 3-5 business days
  • Europe: 5-10 business days
  • United Kingdom: 5-10 business days
  • Rest of the world: 10-20 business days

Shipping costs are calculated at checkout. Free shipping is available for orders over €50 within Spain.

We are not responsible for delays caused by customs, postal services or events beyond our control.

5. Returns and Refunds

You have 14 days from delivery to return any item, in accordance with EU consumer rights (Directive 2011/83/EU).

To initiate a return, contact us at victorlatorreuceda@gmail.com with your order number.

Conditions:

  • Items must be unworn, unwashed and in original condition.
  • Items must be returned in their original packaging.
  • Return shipping costs are the responsibility of the buyer, unless the item is defective.

Refunds will be processed within 14 days of receiving the returned item, using the original payment method.

Non-returnable items: items marked as final sale, gift cards.

6. Right of Withdrawal

Under EU consumer law, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason. To exercise this right, contact us by email before the deadline.

7. Warranties and Liability

All products are sold as described. For upcycled items, minor signs of previous use (softened fabric, faded areas) are inherent characteristics, not defects.

We are liable for defective products under Spanish consumer protection law (Real Decreto Legislativo 1/2007). You have 3 years from delivery to claim for lack of conformity.

Our liability is limited to the purchase price of the item. We are not liable for indirect or consequential damages.

8. Intellectual Property

All content on this website — including text, images, logos, and design — is owned by Brand New Clothes or used with permission. You may not reproduce, distribute or use any content without our written consent.

9. Governing Law and Disputes

These terms are governed by Spanish law. Any disputes will be subject to the courts of Zaragoza, Spain, without prejudice to your rights as a consumer under EU law.
